Whoever they are used to being with.
I doubt, but don't know for sure, that Michael Jackson looked after them at all times. Therefore at this presumably difficult time, they should be with people who they are comfortable with, and used to being around.
The mother, again I am assuming, does not see them all that often, so why put them in unfamiliar surroundings?

Unless there is a problem with her behaviour, such as drug addiction, the mother should have them.

Don't forget he managed LaToya and Janet Jackson as well.
After reading a bit more about this it would seem their natural mother hasn't had anything to do with them for a while and apparently she han't shown up to claim the kids yet. Also the surrogate mother of the third child has never been identified so I wonder if she'll stake a claim now.
