As a mackem I hope the geordies come back up.  Whilst I had one of my best summers ever at the expense of my many geordie mates (and after many years of being the poor relation I fully milked it) I feel a sense of something missing not playing them this season.  When the fixtures came out there was no stand out games to look for.  

I have been suprised and impressed by their start.  Whether it continues will, IMHO, depend on Hughton's ability to prevent any kind of bad run or rot setting in.  The fact there is still bad eggs in the dressing room is evident and that has to be managed properly - if he can do this he has a 1st 11 that will accumulate points although scoring lots and lots of goals is unlikely to be the route to achieving it.

I honestly hope they do it though.  (6 points next season will be most welcome   )

This is far from funny but it does concern Newcastle. I fail to see what case Keegan has if he walked out, his only hope then would be to prove constructive dismissal. Victory for him would jeopardise many of the top clubs who have sacked managers.

KKs argument ("constructive dismissal")  is that the conduct of teh employer was such that either through breach of specific terms or implied contractual terms (mutual trust and confidence) they had onducted themselves ina way which he was entitled to treat as being a fundamental breach of contract; ie that the club was not abiding by the terms.  This would be by their conduct over transfers, I suspect.

THE LAW IS SUMMARISED AS FOLLOWS

Just as the employer may lawfully dismiss without notice if the employee commits a repudiatory breach of contract, so too the employee may lawfully quit without notice if the employer commits a repudiatory breach. Resignation may be interpreted as an election by the employee to treat himself as discharged from his contractual obligations by reason of the employer's breach. It might have been called 'summary resignation'. Instead, it tends to be called, at least for statutory purposes, 'constructive dismissal'. The same point can be made as before: if the employer repudiates the relationship of employer and employee (eg by sacking the employee), then he inevitably repudiates the contract of employment. But he can repudiate the contract while professing to uphold the relationship. Thus many of the cases of constructive dismissal are cases where the employer is attempting to force some unwanted variation of contract on the employee: trying to make him move to some distant workplace, trying to make him do some different kind of work, trying to demote him. Another common example is purporting to suspend the employee from work when the contract does not provide for suspension.



I can't see the damage to reputation claim succeeding, based on KKs history.

Fat Ash claiming a loss to KK will mean us going into administration (farce)

yet there we are, top of the league.

I have read the decision and am (posh eh?) ging on Radio Newcastle to discuss it this evening.

£2 million was the liquidated damages clause in the contract. I m amazed (given the evidence as recited in the decision) that this has gone on so long.

Time for club, supporters and KK to move on

Was checking out the time for the Tranmere game tomorrow and noticed a programme about the Newcastle Fairs Cup team from '69 is on at 10pm tomorrow night Sky Sports 1.

Might be worth a watch

At least that team won a major trophy, cringefest the time the team from the 90's were on this show. How we bottled the times of our lives!
